The Supreme Court of the Philippines has clarified that the term “forthwith” in the Constitution means within a reasonable time, not immediate action, in relation to impeachment proceedings.
In a 14-0-1 vote, the court’s en banc dismissed a petition seeking to compel the Senate of the Philippines to immediately convene as an impeachment court for Vice President Sara Duterte.
The court ruled that mandamus cannot be used to direct the Senate, as it is a co-equal branch of government with its own constitutional powers.
It emphasized that the judiciary cannot interfere with Senate actions within its jurisdiction unless there is a clear showing of grave abuse of discretion.
The ruling comes amid debates over the interpretation of “forthwith,” which became a key issue during discussions on the timing of impeachment proceedings.
The decision effectively affirms the Senate’s discretion in preparing for an impeachment trial.
